Landlord Information – Know Your Responsibilities
At NEXA RE, we believe informed landlords create better rental experiences. As a property owner, it’s your legal responsibility to ensure the safety and livability of your rental property. Not only must you uphold common law obligations, but you’re also required to comply with specific regulations in your state or territory.
General Landlord Responsibilities Include:
- Maintaining the structure and exterior of the property
- Ensuring all essential services (gas, electricity, water, heating) are safe and functional
- Maintaining appliances and installations that are provided with the property
- Addressing potential health hazards, such as dampness or mold
- Fulfilling all terms outlined in the tenancy agreement
Each Australian state and territory has its own regulations that landlords must follow. Here’s a summary of key landlord obligations across the country:
Australian Capital Territory (ACT)
- Provide the tenant with The Renting Book before the lease begins
- Issue a bond receipt and lodge the bond with the Office of Regulatory Services within 2 weeks
- Provide two copies of the Condition of Premises Report within one day of move-in
New South Wales (NSW)
- Give tenants the New Tenant Checklist before the rental agreement is signed
- Understand anti-discrimination, fair trading laws, and required notice periods (90 days if no renewed lease)
Northern Territory (NT)
- Provide tenants with A Guide to Renting in the Northern Territory
- Complete and sign a condition report with the tenant and provide a copy within 7 days
Queensland (QLD)Ensure the property is clean, secure, and in good repair
- Provide keys for all locks and respect the tenant’s privacy
- Give proper notice before entering the property
South Australia (SA)
- Comply with the Residential Tenancy Act 1995
- Maintain the property, provide receipts, lodge the bond, and keep thorough records
Tasmania (TAS)
- Provide a copy of Renting in Tasmania
- Ensure written tenancy agreements, condition reports, and correct notices are handled properly (14–28 days for lease termination)
Victoria (VIC)
- Provide the Renting a Home: A Guide for Tenants booklet
- Give 24 hours’ notice before entry and comply with inspection and access rules
Western Australia (WA)
- Provide tenants with Schedule 2 – Information for Tenants along with the lease
- Understand rights regarding urgent repairs, rent, discrimination, and access
